i was coming around a corner were a moving truck was block the road and my line of vision. A 15 year old kid in a car was also coming around the corner hitting me head on on my bike, i was not injured there was no police report and it happened on private property. now the insurance company of the guy i had the accident with is calling me telling me that there going to sue me can they do this?
i did not have motorcycle insurance but i do have insurance for my truck. i had just bought the bike that day isnt there some kind of grace period? should i still call my insurance company and see if they can help me thanks

Sure they can.

If you are the cause of the damage to their policy holders car- then they can and will sue you. They may be able to get your drivers license suspended as well.

That’s what happens when you choose to drive a vehicle with out insurance – you end up being personally responsible for any and all damage/injuries you cause.

Will the insurance company go after the vandal/s of my property?

Recently my daughter caught my neighbor stabbing our above ground swimming pool, and our trampoline. When he seen her looking out the window, he jumped the fence, and ran through his back gate. The police state in the report that the wife, and husband had two different stories when they talked to them as to his whereabouts, and the neighbor was very nervous, and sweating… In short, the police didn’t believe him. Anyway, the insurance company gave us 1800 dollars, and wanted a copy of the police report so they can take the neighbor to court. Will they really do this, and what usually happens if, and when they do?
A detective has been asigned to the case, and we were advised by him to file our own charges, which we did that too.
To bostonianinmo, thanks for the comment. You mentioned that my neighbor was a kid. Well, he’s a 30 year old man. I know, I know… My son is a brown belt in Karate, and this guy staged a fight between my son, and his, without my knowledge, of course, because he thought Karate was “crap”. Well, my son beat his son, and ever since, this guy has harrassed us/my 11year old especially, and now we’ve sold our home, and buying a new one, just to get away from this psycho. We even built a 6 ft fence, but that made him worse. Now, we’re moving, because we’re literally afraid for the welfare of our son.

Yeah, I’d say that it’s a certainty that the insurance company will go after the parents for compensation.

The insurance company’s attorney will probably write a letter demanding that they pay and threatening suit if they don’t. Most folks would be smart to fess up at that point as it would likely cost them more than $1,800.00 in attorney’s fees to defend the suit, one that they are certain to lose.

At any rate, you don’t need to worry! Just cooperate with your insurance company and watch the neighbors squirm. ;)

Are you asking if the store you rented a TV from has insurance on the TV? Did you damage the TV or something? Look at your contract and see what the agreement says and if there is anything about lost or damaged items and if you are liable.

They are not health insurance. They will not work the same way.

The automobile liability will not pay bills as you incur them. They will not pay lost wages while you are out.

Once you have been released from the Dr and are feeling better. They will order copies of all your medical bills/reports. You can submit documentation from your employer about your lost wages. Depending on how long you are out for, they may want to see a pay stub or W-2.

Once they have all the documentation on your injury – they will evaluate it and make a lump sum offer. The offer will be in exchange for you (and spouse if married) signing a final release that ends the claim once and for all.

If you have Medical Payments Coverage or Personal Injury Protection coverage on your policy, you can turn your bills into that coverage for payment. These coverages can pay medical bills as they are incurred up to the policy limit.

Your personal bills are your responsibility. You would incur those even if the accident had not happened. They are not related to the injury — they are your responsibility.

Personal Property Insurance Claim from a fire, all contents destroyed!?

Last weekend, while I was away, there was a terrible fire in my home. I was notified 3:45am by a neighbour telling me my entire home was on fire. My wife and I quickly left my in laws and rushed to our home, which was 2.5 hours away. When we finally got there, it was day light and to our shock, our entire home was destroyed, remaining was only a deadly looking frame of our home.

My wife could not take the emotions so we had to leave. I had to come right back and answer questions for the fire investigation. At a later point, I walked through a part of the house, and there is nothing but melted materials and broken walls, with pools of black water coming down from the ceilings.

My question is this: I just got off the phone with my insurance company, State Farm. They had a claim adjuster who already had our file. He assured me that he will help with the process and that State Farm will make sure their customers are satisfied at any expense. He went through some of the time lines (he wont be able to meet me for another two weeks, which was a bit surprising), explained that we will have to send him a list of our contents and warned us not to speak to any private adjusters who may attempt to trick us into signing some kind of document or something, I dont really know what he was talking about. Well, what got me worried was this contents worksheet he emailed me. He told me that I must include every single brand, every serial number and every model number and dimensions, if applicable. He told me that we must also prove that we owned each item, or we are not covered for it. He also pointed to this Insurance Fraud statement which I have to sign on each page of the inventory.

Sorry for the long question, I am just very nervous and stressed… Here are my questions:

1) How are we going to be able to remember each and every belonging that we had in the house?
2) The Insurance company is so strict with having all the model numbers and serial numbers, how do would we ever get this information? Can we contact the manufactures and try to get it from them?
3) What would happen if we accidentally write in the wrong info, ie the wrong model number, or the wrong brand?? Our adjuster indicated that anything we claim is subject to insurance laws and we could be criminally charged for insurance fraud by misrepresenting our claim!
4) We have $350,000 worth of contents insurance, and our home was very full. What happens if we can only remember $100,000 worth of our personal property??

I am a doctor, but this situation is very complicated, I have no idea what to do. My wife is a wreck and I do not want her to know that I am as much of a wreck as she is. If anybody has experience with this type of loss, please help!!

I am very sorry that you have lost your home. In terms of answering your questions. One of the best ways that I can suggest to help you remember your contents is to go through pictures of family events held at your home — other family members should be of help in obtaining these pictures, Go through — you will be surprised at how much this will help you in pulling together information for that inventory form. Also if you are on Facebook or other social media websites or some other site where you have stored your photos. The other consideration for the larger ticket items that have been purchased most recently is that you contact your credit card companies for documentation and you can even use these to calculate your clothes and or other items. Also double check with family members and friends that might have given you gifts over the years so that you can include these in the inventory. Just to let you know the adjuster is just giving you this information about the Insurance Fraud because they are required to — it helps to dissuade some people from doing it.

In terms of the fact that your adjuster is stating that he can’t see you for two weeks — that is highly unusual. Everyone of the major companies that I work with would have their first meeting with a client who suffered this type of loss within 24 hours unless it was a major holiday or many clients were affected at the same time such as a hurricane for example and even then insurance companies do triage and will go to those that have total losses first. In your case, I would ask to speak with the supervisor to try to see if you can get a better response time.

Private Adjusters or Public Adjusters will sometimes approach clients that have had major losses such as yours. While some of these can be very professional and can be advantageous — many more are nothing but scam artists that prey on people who are very vulnerable and suffering from the emotional trauma of these type of major losses. Also note that when you get to the point to start re-building that you do a lot of research prior to selecting the contractor since I have seen countless cases where the contractor does not complete job anywhere close to on time and this can cause you more trauma. Be sure to include the phrase time is of the essence in any construction contract and that you include a daily penalty for going over the date of completion.

I do advise you to consider working with someone to help you and your wife cope with this stress. What you are both experiencing right now is a form of PTSD since this type of loss is a major traumatic event.

Do they keep them as well as details about the items on file for future reference? Such as: furniture, televisions, property, etc..

Is there any insurance loss estimating software homeowners can buy to calculate losses for claims?

In order to negotiate with the insurance company, it would be useful to have a software package that would help itemize, price, calculate, and estimate, not only the value of contents but also the cost per square foot of restored construction, the labor cost of tearout of damaged property, debiris disposal costs, etc. Insurance companies have such software packages. It would be great if the insured could also use one.

There are two main software packages that insurance companies use. It would be cost prohibitive for a homeowner to purchase it. However, most contractors that do insurance repair work have the same programs. The easiest thing for a homeowner to do is have their contractor put together an estimate for the repairs. If there is a price difference from the adjusters estimate – then the contractor and adjuster will work it out – or you can just send the contractor estimate to the adjuster to review.

Is the insurance industry a scam?

I’ve paid premiums for insurance for years. We had a flood of black water due to a sewer backup that damaged a lot of property and our insurance company suddenly points our exclusions in our policy that state they won’t cover damage due to this. What is the point of having insurance if they don’t cover for things that are likely to happen?

They are more than happy to take my money, but when I need them they get really tight. Who reads all those pages of fine print?
I understand that insurance can’t cover everything, but the whole point is to cover things that are likely to happen. Fire, flood (water damage), theft and vandalism would cover most things that are likely to happen to a home. Sewer backup should be covered under water damage.

They cover water damage if MY plumbing backed up, but just not the sewer line.

They also cover if an airplane crashes into my house. What are the odds of that?

“Oh, your house was destroyed on a Tuesday during full moon by a fire started in the kitchen, I’m sorry if you read the 8pt font exclusions to your policy that’s not covered. If it started in the living room it would be covered” That is about as arbitrarily insane as what I’m up against!

My agent is a friend of mine and is trying to help as much as he can. I don’t blame him. It is just an eye-opener to how messed up the whole industry is.

Did your agent not discuss the exclusions of your policy? Most homeowners policies do not cover sewer back up, but I personally pay more for my insurance that does cover it. This is a good example of why you should never buy insurance over the Internet. Internet insurance is about sales only, not making sure you get what you need and servicing the account after it is sold.

I have heard a lot of people complain about insurance, but I have also had people send me flowers and thank you notes for keeping them from going bankrupt due to a loss, whether it’s a liability loss or a medical (health) issue.

Find a good local agent in your area and change carriers so this does not happen again. Local agents live in the same community that you do, and usually care a little more about their clients than ones that live out of town.

I am sorry you had this awful experience. It is not a good way to find out how good your coverage really is.

Okay, here we go again – if you are responsible for damaging the tool box and the car, then your property damage liability coverage will pay for the toolbox and the car, but you are NOT covered for the damages to YOUR truck. Why would your insurance company lie to you?
